1. License Grant
When you purchase ListingGems, you receive a perpetual, non-exclusive, non-transferable license to use the software on up to 3 devices. This is a one-time purchase — no recurring payments or subscription fees.
You may use ListingGems for personal or commercial purposes, including processing product photos for sale on any marketplace.
2. License Restrictions
You may not:
- Redistribute, resell, or sublicense ListingGems or your license key
- Reverse engineer, decompile, or disassemble the software
- Share your license key with others outside your own devices
- Remove or alter any copyright notices in the software
- Use ListingGems to build a competing product or service
3. Device Activations
Each license allows activation on up to 3 devices. You can deactivate a device at any time from the Settings menu to free up an activation slot. If you need additional activations, contact us.
4. Refund Policy
We offer a 45-day money-back guarantee, no questions asked. If ListingGems doesn't meet your needs for any reason, contact us within 45 days of purchase for a full refund.
5. Updates
Your purchase includes all future updates at no extra cost. Updates are delivered through the built-in updater and are always optional — the software will prompt you before installing.
6. Intellectual Property
ListingGems and its source code, AI models, and documentation are the intellectual property of ListingGems. Your purchase grants you a license to use the software, not ownership of it.
Images you process with ListingGems remain entirely yours. We claim no rights to your photos, processed outputs, or any content you create with the software.
7. Disclaimer of Warranties
ListingGems is provided "as is" without warranties of any kind, express or implied. While we strive to make the software reliable and useful, we do not guarantee that:
- The software will be error-free or uninterrupted
- Processing results will meet specific marketplace requirements in all cases (always verify compliance with your marketplace's current guidelines)
- AI models will produce perfect results for every image
8. Limitation of Liability
To the maximum extent permitted by law, ListingGems and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the software. This includes, but is not limited to:
- Lost profits or revenue from marketplace listing rejections
- Data loss (though the software does not modify your original files)
- Business interruption or delays
- Costs of procuring substitute services
Our total liability for any claim related to the software shall not exceed the amount you paid for your license.
9. Marketplace Compliance
ListingGems provides marketplace presets based on publicly available platform guidelines. However, marketplace requirements change over time. You are responsible for verifying that your exported images meet the current requirements of your target marketplace. ListingGems is a tool to help you comply, not a guarantee of compliance.
10. Third-Party Components
ListingGems uses open-source AI models (BiRefNet, BEN2, HFA2k by Philip Hofmann, licensed under CC BY 4.0) and libraries. These components are subject to their respective open-source licenses. The use of these models within ListingGems is covered by your ListingGems license.
11. Termination
Your license is perpetual as long as you comply with these terms. We reserve the right to terminate your license if you violate these terms, particularly the restrictions in Section 2. In the event of termination for cause, no refund will be issued.
12. Changes to These Terms
We may update these terms from time to time. Changes will be posted on this page. Continued use of ListingGems after changes constitutes acceptance of the revised terms.
13. Governing Law
These terms are governed by the laws of Bulgaria. Any disputes shall be resolved in the courts of Bulgaria.
